Google Play Payment Plan Terms of Service

  1. Acceptance of Terms

    By purchasing a subscription with a monthly installment payment plan through Google Play (a “Payment Plan”), you agree to these Google Play Payment Plan Terms of Service (the “Terms”) as well as the Google Play Terms of Service, which these Terms incorporate, supplement, and amend with respect to Payment Plans. If there is a conflict between any part of these Terms and the Google Play Terms of Service with respect to a Payment Plan, these Terms will control. Any terms used but not defined in these Terms will have the meaning given in the Google Play Terms of Service.

  2. Separate Sale Contract

    These Terms form part of the separate sale contract between you and the relevant Provider. Each Payment Plan is entered into between you and the Provider, with Google acting as a service provider to the Provider with respect to facilitating and servicing the Payment Plan. The specific terms of your Payment Plan regarding the amounts due and timing of payments are stated on your purchase receipts provided by Google Play and are incorporated into these Terms by reference.

  3. Availability

    Based on your address in your Google payments account (your “Address”), you may have the option to pay for certain subscriptions through a Payment Plan. These Terms apply to Payment Plans made available in the locations listed here. Payment Plans made available in certain states will also be subject to a separate retail installment agreement between you and the Provider, with Google acting as a service provider to the Provider with respect to facilitating and servicing the Payment Plan.

  4. Your Information

    You represent and warrant that your Address is current and accurate. If your Address changes while your Payment Plan is active, you will need to update your Address to reflect that change. You agree that you will not present any false, inaccurate or misleading information in an effort to misrepresent your Address, and you will not attempt to circumvent any restrictions on access to or availability of a Payment Plan. If you delete your Google payments account or your Google account that is associated with your purchase of your relevant subscription paid via a Payment Plan, subject to applicable law, you may continue to be charged according to your payment schedule or, at the Provider’s discretion, any remaining installment payments owed for such purchase may immediately become due and the Provider may charge such amounts in full.

  5. Payment Authorization and Commitments
    1. If you are eligible and choose to purchase a subscription with a Payment Plan, your purchase of such subscription for the relevant subscription term is made once your first payment for that subscription term has been charged. For example, if you purchase a subscription for an annually recurring sports season with a Payment Plan that includes four total payments for each season, your purchase for each season is made once the first payment for that season is charged. For subscriptions paid via a Payment Plan and for purposes of these Terms, a subscription term means the period starting on the date of your first payment under the applicable Payment Plan and ending on your next renewal date.
    2. Once you have purchased a subscription with a Payment Plan, you agree to make, and authorize Google to charge your designated payment method on a recurring basis for, all remaining installment payments for the relevant subscription term as they become due. Additionally, for electronic fund transfers: (a) you authorize Google to process regularly scheduled charges, on a recurring basis, to your designated payment method for the applicable amounts for the relevant Payment Plan (which may vary based on applicable sales tax); (b) you understand that you have the right to receive a notice, at least 10 days in advance, whenever a transfer under this authorization will vary from the prior transfer under the authorization, but you agree that Google will only provide you with notice of a change of the payment amount if such change is due to any reason other than variance in sales tax, bank processing fees, or currency exchange fees; and (c) you understand that, as an electronic funds transfer, these funds may be withdrawn as soon as the applicable transaction date(s).
    3. ONCE YOU PURCHASE A SUBSCRIPTION WITH A PAYMENT PLAN, YOU CANNOT CANCEL ANY REMAINING INSTALLMENT PAYMENTS UNDER THAT PAYMENT PLAN FOR THE THEN-CURRENT SUBSCRIPTION TERM. You may choose not to renew your subscription at any time, however, such non-renewal will only be effective at the end of the current subscription term purchased via the Payment Plan. Google Play will not issue refunds except as otherwise provided in Google Play’s Refund Policy. The Provider may issue refunds subject to its refund policies. You commit to pay the full price for your subscription shown at checkout, and you are obligated to continue making payments until you have paid the full amount, even if you decide not to renew your subscription. You will not dispute any of the installment payments with your bank, provided the transactions correspond to these Terms and any other applicable payment terms between you and Google. The applicable Provider may accept late or partial payments with respect to any Payment Plan, or delay in enforcing its rights under any Payment Plan, without waiving any of the Provider’s rights under such plan.
  6. Payment Method

    You may change your designated payment method for your Payment Plan at any time to another accepted form of payment. For example, if you pay with a debit card today, you may update your form of payment to pay by another accepted method, such as a credit card, at a later time. You can change your designated primary or backup payment method for your Payment Plan by navigating to the “Payments and subscriptions” section of your Google Play account, selecting the relevant subscription, and updating the primary or backup payment method. To remove a payment method from your Google payments account or to update the details of a payment method (for example updating the expiration date of a credit card), you must make the change in your Google payments account at payments.google.com. To ensure an upcoming payment is charged to your updated payment method, you will need to make the update at least one day before the applicable payment is due.

  7. Payment Issues and Payment Default
    1. If an installment payment charged for your Payment Plan is returned or cannot be otherwise completed, you acknowledge that Google may, as servicer for the Provider and prior to your Payment Plan going into payment default, re-submit the installment payment up to the number of times permitted by applicable law and payment system rules. You also authorize Google to collect the installment payment from your designated alternative payment method or any other payment method saved to your Google payments profile.
    2. Your Payment Plan will be deemed in payment default when both of the following have occurred: (a) you have failed to pay any one of your installment payments under your Payment Plan on the scheduled date; and (b) Google has sent a formal notice to the email address you used to purchase the relevant subscription expressly stating that your Payment Plan is in “payment default.”
    3. If you fail to pay an installment payment in your Payment Plan, then, subject to any payment grace period the Provider may offer, your subscription may be suspended or canceled and you may lose access to the subscription. If your subscription is suspended or canceled for failure to pay an installment payment, you may not be eligible to pay for future subscriptions on Google Play using a Payment Plan. Where possible, Google will notify you when you have an installment payment that is outstanding and a related action has been taken on your account. You agree that, regardless of any suspension or loss of access to or use of the applicable subscription due to failure to make a payment for your Payment Plan, you remain liable to pay any outstanding amounts due under such Payment Plan.
  8. Responsibility for Third Party Fees

    Any payment by means of third party payment cards or other third party payment methods may be subject to terms, including fees, not imposed or controlled by Google or the Provider. You are responsible for any finance or interest charges or fees that your credit card provider or other issuer of payment method may apply. You agree that neither Google nor the Provider are responsible or liable for any fees you incur in connection with your credit card or otherwise due to you having insufficient funds.

  9. Accessing Payment Plan Information

    You can view the amount of your installment payments, upcoming charges, total number of installment payments, number of any installment payments past due, total outstanding balance, and the next renewal date for your subscription plan anytime in the “Payments and subscriptions” tab of your Google Play account settings. You can view past installment payments in the “Budget and history” section under the “Payments and subscriptions” tab of your Google Play account settings.

  10. Consent to Doing Business Electronically
    1. Google may communicate with you regarding your Payment Plan by means of electronic communications, including (a) sending electronic mail to the email address you used to purchase the relevant subscription, or (b) posting notices or communications on a Google Play web site or another Google website or mobile application. You agree and consent to receive electronically all communications that are required under applicable law to be provided in writing and that are provided to you in connection with these Terms or your Payment Plan and the corresponding subscription.
    2. You should maintain copies of electronic communications by printing a paper copy or saving an electronic copy. Electronic communications shall be deemed received by you when we send the electronic communication to the email address you used to purchase your relevant subscription, or when we post the electronic communication on a Google Play website or another Google website or mobile application.
    3. In order to access and retain electronic communications, you will need to maintain or have access to the following computer hardware and software at your own expense:

      (a) a device that is compatible with Google Play and meets the system and compatibility requirements;
      (b) a current web browser that includes 128-bit encryption (e.g. Internet Explorer version 6.0 and above, Firefox version 2.0 and above, Chrome version 3.0 and above, or Safari 3.0 and above) with cookies enabled;
      (c) the appropriate mobile application, in the case of communications delivered through such application;
      (d) software capable of opening documents in PDF format;
      (e) access to the valid email address you used to purchase the relevant subscription; and,
      (f) sufficient storage space to save past communications or a printer to print them.

      By giving your consent to these Terms, you confirm that you are able to meet the above requirements, and that you can receive, open, and print or save any communications referenced in these Terms for your records.

    4. For those communications or records that we or the Provider are otherwise required under applicable law to provide in a written paper form to you, you agree that we may provide such communications or records by means of electronic communications. The following additional terms will apply to such electronic communications: (a) you may contact us through the contact page to update your registration information used for electronic communications or to withdraw consent to receive electronic communications; and (b) we reserve the right to terminate your relevant subscription and Payment Plan if you decline or withdraw consent to receive electronic communications from us. Deleting your Google payments profile or your Google account and/or canceling the subscription itself will also not result in withdrawal of your electronic communications consent.
